Welcome to Blackwolf Designs.

These Terms of Service (“Terms”) govern your use of the Blackwolf Designs website, online store, products and services.

Throughout these Terms, “Blackwolf Designs”, “we”, “us” and “our” refer to Blackwolf Designs. “Customer”, “you” and “your” refer to any person who accesses our website, communicates with us regarding an order, places an order or purchases or uses our products or services.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to sell our products and services.

By accessing our website, placing an order, making payment, approving a custom design, booking an installation or otherwise using our services, you agree to these Terms and our applicable policies.

These Terms must be read together with our:

• Privacy Policy;
• Return, Refund & Cancellation Policy; and
• Shipping & Delivery Policy.

Nothing in these Terms is intended to exclude, restrict or override any rights that cannot lawfully be excluded under applicable South African law, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Protection of Personal Information Act 4 of 2013 (“POPIA”).

1. GENERAL CONDITIONS

By using our website or purchasing from Blackwolf Designs, you confirm that you have the legal capacity to enter into a binding agreement or that you are acting with the necessary consent or authority.

You may not use our website, products or services for any unlawful or unauthorised purpose.

You may not attempt to interfere with, damage, compromise or gain unauthorised access to our website, systems, accounts or associated services.

We reserve the right to refuse service, cancel an order or restrict access to our Services where reasonably justified and permitted by law.

2. PRODUCTS AND SERVICES

Blackwolf Designs supplies products including, but not limited to:

• Custom automotive accessories;
• Showplates;
• Gel badge overlays and inlays;
• Replacement badges;
• 3D-printed products;
• Stickers and vinyl graphics;
• Custom automotive merchandise;
• Apparel;
• Keyrings;
• Key holders;
• Printed merchandise;
• Vehicle-specific accessories;
• Custom designs; and
• Other automotive and custom-manufactured products.

Our product range may change at any time.

We may introduce, modify or discontinue products without prior notice, subject to orders already accepted and any applicable consumer rights.

3. CUSTOM AND MADE-TO-ORDER PRODUCTS

Many Blackwolf Designs products are manufactured specifically for individual customers.

Customers acknowledge that custom, personalised and made-to-order products may be produced according to:

• Vehicle information;
• Customer measurements;
• Colours;
• Wording;
• Names;
• Registration numbers;
• Logos;
• Artwork;
• Designs;
• Sizes;
• Finishes; and
• Other specifications selected or supplied by the customer.

Customers are responsible for ensuring that all information supplied is accurate before production begins.

Where Blackwolf Designs correctly manufactures a product according to information supplied or approved by the customer, an error in the information supplied by the customer does not constitute a manufacturing defect.

4. DESIGN APPROVAL

Where Blackwolf Designs provides a mock-up, digital proof or design for approval, customers must carefully review the design before approving production.

The customer is responsible for checking:

• Spelling;
• Names;
• Numbers;
• Vehicle information;
• Colours;
• Layout;
• Dimensions;
• Logo placement;
• Artwork; and
• Other customisation details.

Once a design has been approved, Blackwolf Designs may begin production.

Approval of the design confirms that the customer is satisfied with the information and general layout shown.

Changes requested after approval or after production has commenced may result in additional charges and may not always be possible.

5. CUSTOMER-SUPPLIED ARTWORK, LOGOS AND CONTENT

Where customers provide Blackwolf Designs with logos, images, photographs, trademarks, artwork, wording or other material for reproduction, the customer confirms that they have the necessary rights, permission or authority to use and reproduce that material.

Blackwolf Designs is not responsible for disputes arising solely from a customer’s unauthorised submission or use of third-party intellectual property.

We reserve the right to refuse to reproduce material where we reasonably believe that doing so may be unlawful, infringing, offensive or otherwise inappropriate.

6. INTELLECTUAL PROPERTY

Unless otherwise stated, original designs, product concepts, photographs, graphics, website content, branding, logos, product images, digital files, 3D models, CAD designs, templates and other material created by Blackwolf Designs remain the intellectual property of Blackwolf Designs or the applicable rights holder.

Purchasing a physical product does not automatically transfer ownership of the underlying design, CAD file, STL file, SVG file, manufacturing file, artwork or other intellectual property used to produce that product.

Customers may not reproduce, manufacture, copy, distribute, resell, reverse engineer or commercially exploit Blackwolf Designs’ proprietary designs or digital files without our prior written permission, except where permitted by law.

Custom design work created specifically for a customer remains subject to any intellectual-property arrangement agreed between Blackwolf Designs and the customer.

7. PRODUCT IMAGES AND COLOURS

We make reasonable efforts to display products accurately.

However, customers acknowledge that colours may appear differently depending on:

• Screen settings;
• Device displays;
• Lighting conditions;
• Photography;
• Material batches; and
• Manufacturing processes.

Small differences between digital representations and physical products do not necessarily constitute defects.

8. 3D-PRINTED AND HAND-FINISHED PRODUCTS

Some Blackwolf Designs products are produced using additive manufacturing, resin finishing, vinyl application or other custom production processes.

Minor characteristics associated with these processes may be visible, including:

• Layer lines;
• Seams;
• Small surface variations;
• Minor texture differences; and
• Slight differences between individual units.

Such characteristics do not necessarily constitute defects where they are normal consequences of the manufacturing method and do not materially affect the intended function or overall quality of the product.

9. VEHICLE COMPATIBILITY AND FITMENT

Customers are responsible for providing the correct vehicle make, model, year, generation and any other relevant specifications when purchasing vehicle-specific products.

Customers should confirm compatibility before purchasing where fitment depends on a particular vehicle variant.

Blackwolf Designs will not be responsible where a product has been correctly manufactured or supplied according to incorrect vehicle information provided by the customer.

Where we specifically confirm compatibility based on information supplied by the customer, we will use reasonable care to provide the appropriate product.

10. INSTALLATION AND FITMENT

Certain products may require professional or careful installation.

Where Blackwolf Designs performs installation, we will take reasonable care when carrying out the work.

Where a customer installs a product themselves or uses another person or business to perform installation, Blackwolf Designs is not responsible for damage caused by incorrect installation, inappropriate tools, excessive force, incorrect wiring, improper surface preparation, unsuitable chemicals, unauthorised modification or failure to follow supplied instructions.

Customers should contact us before installation if they are unsure about the correct fitment method.

11. VEHICLE PHOTOGRAPHY AND MARKETING

Blackwolf Designs may photograph or record completed products, installations, custom orders and customer vehicles for portfolio, promotional and marketing purposes.

Such content may be used on Blackwolf Designs’ website, social-media accounts, advertising, catalogues and other promotional channels.

Customers who do not want their vehicle or completed work photographed or used for marketing purposes should notify Blackwolf Designs before collection, delivery or installation, or before photographs or recordings are taken.

We will take reasonable steps to avoid unnecessarily displaying personal information such as residential addresses, telephone numbers or other private information.

Vehicle registration numbers may be obscured where appropriate.

Where a customer is personally identifiable in marketing material, additional consent may be requested where required by law.

Where customers voluntarily send photographs, videos, reviews or testimonials to Blackwolf Designs for sharing or promotional purposes, they grant us permission to use such material for the intended purpose, subject to applicable law.

12. PRICING

All prices displayed by Blackwolf Designs are in South African Rand (ZAR) unless otherwise stated.

Prices may change without prior notice.

A price change will not ordinarily affect an order that has already been accepted and paid for, unless otherwise permitted by law.

We make reasonable efforts to ensure pricing is accurate.

Where an obvious pricing or listing error occurs, we reserve the right to correct the error and deal with affected orders in accordance with applicable consumer law.

13. PAYMENT

Orders may require full or partial payment before production begins.

An order will not be considered confirmed until any required payment has been received or otherwise confirmed.

Where a deposit is accepted for custom work, the applicable payment terms will be communicated to the customer.

Customers are responsible for ensuring payment information is correct.

Payments made through our website may be processed by Shopify and/or third-party payment providers.

14. PRODUCTION AND LEAD TIMES

Production times vary depending on:

• Product type;
• Customisation;
• Order quantity;
• Material availability;
• Current workload;
• Equipment availability; and
• Other production requirements.

Any completion date or lead time provided is an estimate unless expressly agreed otherwise.

We will make reasonable efforts to complete orders within communicated timeframes but cannot guarantee against delays caused by circumstances outside our reasonable control.

15. SHIPPING AND DELIVERY

Shipping within South Africa starts from R150.

The final courier charge may increase depending on the parcel’s:

• Size;
• Weight;
• Quantity;
• Destination; and
• Special handling requirements.

Blackwolf Designs currently makes use of The Courier Guy for courier services.

Delivery time is separate from manufacturing or production time.

16. COLLECTION

Collection may be available by prior arrangement.

Customers must wait for confirmation that an order is ready before arriving for collection.

Where a customer elects to collect an order, responsibility for transporting and protecting the product after collection passes to the customer, subject to applicable law.

17. RETURNS, REFUNDS AND CANCELLATIONS

Because many Blackwolf Designs products are custom-made or personalised, change-of-mind cancellations and returns may not be available once production has commenced.

This does not affect any rights customers may have in respect of defective goods or other rights that cannot legally be excluded.

18. PRODUCT CARE

Customers are responsible for following reasonable product-care and installation instructions.

Depending on the product, damage may result from:

• Harsh chemicals;
• Solvents;
• Abrasive cleaning;
• Excessive pressure washing;
• Incorrect installation;
• Excessive heat;
• Physical impact;
• Modification;
• Improper storage; or
• Use outside the product’s intended purpose.

Damage resulting from misuse, improper installation or external causes will not ordinarily constitute a manufacturing defect.

19. PERFORMANCE, MOTORSPORT AND VEHICLE MODIFICATION PRODUCTS

Certain products sold by Blackwolf Designs may be intended for automotive modification, styling, performance, show or motorsport applications.

Customers are responsible for ensuring that any modification or product installed on their vehicle complies with applicable laws, roadworthiness requirements, insurance requirements and vehicle regulations.

Where a product is specifically described as intended for off-road, competition, motorsport or show use, the customer is responsible for using that product accordingly.

Blackwolf Designs does not guarantee that every aftermarket or modified product will be legal for use on public roads in every application.

20. WARRANTIES AND DEFECTIVE GOODS

Nothing in these Terms is intended to exclude warranties or remedies that apply under the CPA or other applicable South African law.

If a customer believes a product is defective, they should contact Blackwolf Designs as soon as reasonably possible with their order information and clear photographs or videos of the issue.

Valid defective-product claims will be handled in accordance with applicable law and our Return, Refund & Cancellation Policy.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Blackwolf Designs will not be liable for indirect, incidental or consequential loss arising from circumstances outside our reasonable control or from misuse, incorrect installation or unauthorised modification of our products.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by South African law.

22. WEBSITE INFORMATION

We make reasonable efforts to keep information on our website accurate and current.

However, product descriptions, availability, images, specifications and other website information may occasionally contain errors or require updating.

We reserve the right to correct inaccuracies and update website content where necessary.

23. THIRD-PARTY SERVICES

Our website and Services may use or link to third-party services, including Shopify, payment providers, courier companies and social-media platforms.

Blackwolf Designs is not responsible for the independent operation, content or privacy practices of third-party platforms outside our control.

Use of those services may also be subject to the third party’s own terms and policies.

24. PERSONAL INFORMATION AND POPIA

Blackwolf Designs processes personal information in accordance with our Privacy Policy and applicable South African data-protection legislation, including POPIA.

By providing information necessary to process an order, customers acknowledge that such information may need to be shared with appropriate service providers, including payment processors and couriers, for the purpose of completing the transaction.

25. PROMOTIONS AND DISCOUNTS

Promotional offers, launch specials, discount codes and competitions may be subject to additional terms.

Unless otherwise stated:

• Promotions cannot be exchanged for cash;
• Discount codes cannot necessarily be combined;
• Promotions may be limited by availability;
• Promotions may have specific start and end dates; and
• Promotional pricing may apply only to qualifying products or orders.

Statutory consumer rights remain unaffected.

26. REVIEWS AND CUSTOMER CONTENT

Customers may submit reviews, photographs, comments or other content relating to Blackwolf Designs products.

By voluntarily providing content for publication or promotional use, customers confirm that they have the right to provide the content and grant Blackwolf Designs permission to reproduce and display it for the purpose for which it was submitted.

Blackwolf Designs reserves the right not to publish content that is unlawful, abusive, fraudulent, misleading or unrelated to our products or Services.

27. PROHIBITED USE

Customers may not use our website or Services:

• For unlawful purposes;
• To infringe intellectual-property rights;
• To distribute malicious software;
• To attempt unauthorised access to our systems;
• To submit fraudulent information;
• To interfere with website functionality; or
• To engage in conduct prohibited by applicable law.

28. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL

Blackwolf Designs will not be responsible for unreasonable failure or delay caused by events outside our reasonable control, subject to applicable law.

These may include power failures, network outages, courier disruptions, strikes, severe weather, natural disasters, equipment failures, supply shortages, governmental restrictions or similar circumstances.

Where such an event materially affects an order, we will make reasonable efforts to communicate with the affected customer.

29. CHANGES TO THESE TERMS

Blackwolf Designs may update these Terms from time to time to reflect changes to our products, Services, business practices or legal obligations.

The latest version will be published on our website together with the updated revision date.

The Terms applicable to a transaction will be determined in accordance with applicable law.

30. GOVERNING LAW

These Terms and your use of the Blackwolf Designs Services are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and any consumer dispute-resolution rights available to the customer.

31. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary and permitted by law.

The remaining provisions will continue to apply.

32. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return, Refund & Cancellation Policy, Shipping & Delivery Policy and any specific written terms agreed for an order, constitute the terms applicable to your use of our Services and purchases from Blackwolf Designs.
