This Legal Notice applies to the Blackwolf Designs website, online store, products, designs, content and related services.

By accessing or using this website, purchasing a Blackwolf Designs product or otherwise interacting with our services, you acknowledge this Legal Notice together with our Terms of Service, Privacy Policy, Return, Refund & Cancellation Policy and Shipping & Delivery Policy.

Nothing contained in this Legal Notice is intended to exclude, restrict or override any rights or obligations that cannot lawfully be excluded under South African law.

However, product information, specifications, pricing, availability, images, compatibility information and other website content may occasionally contain errors or require updating.

Blackwolf Designs reserves the right to correct errors, update information and make reasonable changes to the website, products and services, subject to applicable South African law.

3. INTELLECTUAL PROPERTY

Blackwolf Designs takes the protection of its original products, designs and intellectual property seriously.

Unless otherwise indicated, original material created by Blackwolf Designs, including but not limited to:

  • Product designs;
  • Product geometry;
  • Custom automotive components;
  • Graphics;
  • Photographs;
  • Videos;
  • Product descriptions;
  • Artwork;
  • CAD designs;
  • 3D models;
  • STL files;
  • Prototypes;
  • Manufacturing files;
  • Templates;
  • Branding;
  • Logos; and
  • Website content,

remains the intellectual property of Blackwolf Designs or the applicable rights holder to the extent protected by applicable law.

Purchasing a physical Blackwolf Designs product does not automatically transfer ownership of any underlying design, CAD model, STL file, manufacturing file, artwork or other intellectual property associated with that product.

No person or business is granted permission merely through purchasing or possessing one of our products to reproduce or commercially exploit Blackwolf Designs intellectual property.

4. SPECIAL NOTICE – BLACKWOLF DESIGNS FIESTA ST180 FENDER BADGES

Particular notice is given to the Blackwolf Designs Ford Fiesta ST180 Fender Badge design.

This product was independently developed by Blackwolf Designs following substantial design work, measurement, prototyping, testing, adjustment and refinement.

The distinctive design was developed specifically to follow the shape and curvature of the Ford Fiesta ST180 fender while providing the intended styling, proportions and fitment developed by Blackwolf Designs.

Blackwolf Designs has invested substantial time, materials, resources and development work into creating this product.

The sale of a Blackwolf Designs Fender Badge is the sale of the physical product only. It does not constitute the sale, transfer, licence or assignment of the underlying design or any intellectual-property rights that Blackwolf Designs may hold in that design.

To the extent protected by applicable law, no person or business may reproduce or commercially exploit protected elements of this design without prior written permission from Blackwolf Designs.

This includes unauthorised reproduction through methods such as:

  • 3D scanning;
  • Photogrammetry;
  • Moulding;
  • Casting;
  • Tracing;
  • Digital reconstruction;
  • CAD recreation;
  • Measurement and reconstruction;
  • Creation of derivative manufacturing files; or
  • Any other reproduction or manufacturing process.

Where prohibited by applicable law, no person or business may manufacture, commission, advertise, distribute or sell unauthorised copies of protected Blackwolf Designs Fender Badge designs.

5. REVERSE ENGINEERING & DIGITAL REPRODUCTION

Where prohibited by applicable law, Blackwolf Designs products may not be acquired for the purpose of unlawfully reproducing protected elements of our designs.

This includes using a physical Blackwolf Designs product to create an unauthorised:

  • STL file;
  • STEP file;
  • CAD model;
  • Mesh;
  • 3D scan;
  • Mould;
  • Template;
  • Manufacturing drawing; or
  • Other reproduction or manufacturing file.

Providing such unauthorised reproduction files to another individual, manufacturer, 3D-printing service or business may also constitute unauthorised exploitation of Blackwolf Designs intellectual property where protected by law.

6. COMMERCIAL COPYING & ENFORCEMENT

Blackwolf Designs expressly objects to unauthorised commercial copying, reproduction, manufacture or exploitation of its legally protected original products and designs.

Where Blackwolf Designs reasonably believes that its intellectual property or legally protected designs have been unlawfully copied, reproduced, manufactured, distributed, advertised or sold, Blackwolf Designs reserves the right to take appropriate legal action.

Depending on the circumstances and rights available under applicable law, this may include:

  • Sending a formal cease-and-desist demand;
  • Demanding that manufacture or sale of infringing products cease;
  • Requesting removal of infringing online listings;
  • Reporting infringing products or content to marketplaces;
  • Reporting infringing content to social-media platforms;
  • Requesting removal of infringing websites or advertisements where appropriate;
  • Seeking legal advice;
  • Applying for an interdict or other appropriate court relief;
  • Instituting legal proceedings;
  • Seeking damages or other monetary relief where legally available;
  • Seeking an appropriate costs order; and
  • Exercising any other remedies available under South African law.

Blackwolf Designs reserves all rights available to it and will take appropriate action where necessary to protect its original products, designs and intellectual property.

The fact that a Blackwolf Designs product is publicly displayed, photographed, advertised, sold or supplied to a customer does not by itself constitute permission for another person or business to reproduce it.

7. CUSTOMER-SUPPLIED ARTWORK & INTELLECTUAL PROPERTY

Blackwolf Designs also respects the intellectual property rights of others.

Customers may request products containing custom logos, wording, images, artwork or other supplied material.

By supplying such material to Blackwolf Designs for reproduction, the customer confirms that they have the necessary permission, licence or legal right to use and reproduce that material.

Blackwolf Designs reserves the right to refuse custom work where we reasonably believe that the requested material may unlawfully infringe another party’s intellectual-property rights.

8. AUTOMOTIVE TRADEMARKS & VEHICLE MANUFACTURERS

Blackwolf Designs manufactures and supplies independent aftermarket and custom automotive products.

Vehicle manufacturer names, model names, trademarks and other references appearing on our website may include Ford, Fiesta, Focus, ST, RS, BMW, Volkswagen and other automotive brands.

These names may be used for identification, compatibility, descriptive or referential purposes.

All third-party trademarks, logos, manufacturer names, vehicle names and intellectual property remain the property of their respective owners.

Unless expressly stated otherwise, Blackwolf Designs is not affiliated with, endorsed by, sponsored by, authorised by or officially connected with Ford Motor Company or any other vehicle manufacturer or trademark owner referenced on our website.

References such as “Fiesta ST180”, “Focus ST”, “RS-style”, “BMW” or similar terminology are intended to identify vehicle compatibility, styling or application and do not represent an official manufacturer product unless expressly stated.

Nothing in this Legal Notice claims Blackwolf Designs ownership over intellectual property belonging to Ford or any other third party.

9. AFTERMARKET PRODUCTS

Unless specifically identified as genuine or original equipment manufacturer (“OEM”), products manufactured or sold under the Blackwolf Designs brand should be considered independent aftermarket products.

Blackwolf Designs does not represent that an aftermarket product is manufactured, approved, licensed or endorsed by the original vehicle manufacturer unless this is expressly stated.

Customers should review the individual product description before purchasing.

10. VEHICLE COMPATIBILITY

Vehicle compatibility information is provided using information reasonably available to Blackwolf Designs.

Customers are responsible for supplying accurate vehicle information, including:

  • Make;
  • Model;
  • Year;
  • Generation;
  • Variant; and
  • Relevant vehicle modifications.

Where Blackwolf Designs correctly manufactures or supplies a product according to incorrect information provided by the customer, Blackwolf Designs will not be responsible for resulting incompatibility, subject to applicable consumer law.

Customers who are uncertain about compatibility should contact Blackwolf Designs before ordering.

11. INSTALLATION & FITMENT

Certain Blackwolf Designs products require installation or fitment.

Where installation is performed by Blackwolf Designs, reasonable care will be taken during installation.

Where installation is performed by the customer or another third party, Blackwolf Designs will not be responsible for damage caused by circumstances such as:

  • Incorrect installation;
  • Excessive force;
  • Incorrect tools;
  • Improper surface preparation;
  • Incorrect wiring;
  • Unsuitable chemicals;
  • Unauthorised modification; or
  • Failure to follow applicable installation instructions.

Nothing in this section excludes liability that cannot lawfully be excluded.

12. MOTORSPORT, PERFORMANCE & MODIFIED VEHICLES

Certain Blackwolf Designs products may be intended for modified vehicles, motorsport, competition, show or off-road applications.

Customers are responsible for determining whether the installation or use of a particular product complies with applicable:

  • Road traffic legislation;
  • Roadworthiness requirements;
  • Insurance requirements;
  • Motorsport regulations; and
  • Other legal requirements.

Products specifically identified as intended for motorsport, competition, show or off-road use should be used accordingly.

Blackwolf Designs does not guarantee that every aftermarket modification is lawful for use on public roads in every application.

13. PRODUCT PHOTOGRAPHY & DIGITAL REPRESENTATIONS

Blackwolf Designs makes reasonable efforts to represent its products accurately.

However, the physical appearance of a product may vary slightly from photographs, renders or digital mock-ups because of:

  • Screen calibration;
  • Lighting;
  • Photography;
  • Material batches;
  • Printing processes;
  • Vinyl;
  • Resin;
  • 3D-printing processes; and
  • Hand finishing.

Minor variations inherent to custom manufacturing do not necessarily constitute defects.

14. CUSTOMER VEHICLES & MARKETING CONTENT

Blackwolf Designs may photograph or record completed products, custom orders, installations and customer vehicles for portfolio and marketing purposes.

Content may be used on our:

  • Website;
  • Instagram;
  • Facebook;
  • TikTok;
  • WhatsApp;
  • Online advertisements;
  • Digital catalogues; and
  • Other Blackwolf Designs marketing channels.

Customers who do not want their vehicle or completed work photographed or used for marketing purposes should notify Blackwolf Designs before photography, collection or installation.

Blackwolf Designs will take reasonable steps not to unnecessarily publish personal information.

Our processing of personal information is further governed by our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (“POPIA”).

15. THIRD-PARTY SERVICES & LINKS

The Blackwolf Designs website may integrate with or provide links to third-party services, including:

  • Shopify;
  • Payment providers;
  • Courier providers;
  • Social-media platforms; and
  • Other external services.

Blackwolf Designs does not control independent third-party websites and is not responsible for their independent content, security, availability or privacy practices.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Blackwolf Designs will not be responsible for indirect or consequential losses arising from misuse, incorrect installation, unauthorised modification or use of a product contrary to its intended purpose.

Nothing contained in this Legal Notice excludes or limits liability where such exclusion or limitation is prohibited by South African law.

17. SOUTH AFRICAN CONSUMER & PRIVACY LAW

Blackwolf Designs operates subject to applicable South African legislation, including, where relevant:

  • Consumer Protection Act 68 of 2008 (CPA);
  • Electronic Communications and Transactions Act 25 of 2002 (ECTA);
  • Protection of Personal Information Act 4 of 2013 (POPIA); and
  • Applicable South African intellectual-property legislation.

Nothing contained in this Legal Notice is intended to waive, exclude or restrict rights that cannot legally be waived or excluded.

18. GOVERNING LAW

This Legal Notice, the Blackwolf Designs website and our Services are governed by the laws of the Republic of South Africa.

Any dispute concerning Blackwolf Designs products, Services, website content or intellectual property will be dealt with in accordance with applicable South African law.

19. CHANGES TO THIS LEGAL NOTICE

Blackwolf Designs may update this Legal Notice from time to time to reflect changes to our website, products, intellectual property, business practices or legal requirements.
